(1) If a report is received in accordance with section 13 for the permission to extradite, the district court may consider the following matters regarding whether or not the fugitive accused or criminal can be extradited:-
(a) Whether or not the requesting state has completed the process under section 7 and 8 or disclosed the details to be disclosed or attached the documents to be attached and requested the extradition of the fugitive accused or the criminal,
(b) whether or not the warrant issued by the requesting State for the arrest of a fugitive accused or offender was issued for the arrest of that person,
(c) Whether or not the absconding accused or the offender can be extradited as per section 3,
(d) The fugitive accused or the offender can be extradited as per section 4 Whether or not related to a cognizable offence,
(e) whether extradition of a fugitive accused or an offender can be refused under section 5 or not,
(f) Whether or not the fugitive accused or offender can be extradited as per the request of the requesting state.
(2) Notwithstanding anything contained in sub-section (1), fugitives Before making an order regarding the extradition of the accused or the offender, the district court may hear the statements of the accused or the offender and additional evidence related to the offence. If it appears from the details, documents and evidence submitted by the executing state that the fugitive accused or criminal can be extradited according to this Act, the district court shall order the extradition. If there is, such fugitive accused or criminal shall be ordered to be detained for a maximum period of forty-five days until the work related to extradition is completed. could not doIf it is not found, the concerned district court shall order that such accused or criminal cannot be extradited.
(6) When ordering according to sub-section (5), if the fugitive accused or criminal is in custody, an order shall also be given to release him from custody.< /p>
(7) According to this section, the district court shall inform the chief district officer through the relevant district public prosecutor about the order given regarding the extradition of the fugitive accused or the criminal.
(8) Sub-section ( 7) The Chief District Officer shall immediately give the information of the order received to the Ministry.
